Terms of Service

PayGov.US provides government sector payment and reporting services to state and local government agencies only. PayGov.us does not provide services to Federal agencies. PayGov.us is not associated with, or endorsed by, the U.S. Department of the Treasury, Financial Management Service (FMS). FMS provides government sector payment, reporting, and other services, to Federal government agencies, under the FMS Pay.GOV service mark.

These Terms of Service (“Terms”) are a legal agreement between you (“you,” “your”) and PayGOV.US LLC (”PayGOV.US,” “we,” “our” or “us”) and govern your use of PayGOV.US’s services, including mobile applications, websites, software, hardware, and other products and services (collectively, the “Services”). If you are using the Services on behalf of a business, that business accepts these terms. By using any of the Services you agree to these Terms, including terms that limit our liability and require individual arbitration for any potential legal dispute. You also agree to any additional terms specific to Services you use (“Additional Terms”), such as those listed below, which become part of your agreement with us. You should read all of our terms carefully.

In order to use PayGOV it is necessary that you understand and agree to these Terms. By attempting to make a payment through PayGOV.US LLC, you confirm that you have read and understood these Terms. You also confirm that you agree to these Terms in their entirety. Furthermore, you understand and agree that these Terms are a valid and enforceable agreement between you and PayGOV.US LLC.

Acceptance of Terms.

By initiating a Transaction you represent and warrant that you are either an adult at least 18 years of age, an emancipated minor, or legally acting within your authority as an agent, contractor, employee, officer or director of an entity or organization. Only such persons which meet these requirements are authorized to initiate payment. As such, we are relying on the fact that you are legally competent and able to contract. Furthermore, that you understand and agree that these Terms constitute a binding obligation upon you or the entity or organization you represent.

Limits of Service.

PayGOV provides a service to process electronic payments to specific entities.  By using PayGOV you affirm that you have chosen to use our service to make a payment to another entity, typically an Agency or a third-party that PayGOV. is assisting.

Questions about Payment.

PayGOV will attempt to address and answer your questions regarding your payment. Specific items may be discussed such as the amount, date, Agency to which it was directed, and payment type. This information is based on system records available to us. You may reach our office between the hours of 8AM-4PM EST M-F at 1-866-480-8552 or [email protected].

PayGOV will not, however, answer questions about the underlying obligation. PayGOV will not discuss, and does not have knowledge of, how your taxes, fees, fines, or other obligations were calculated, nor how an Agency may apply your payment.

Identification Methods

 PayGOV.US LLC will take steps to prevent Card fraud. If we have reason to believe you are not authorized to use the Card you present  then we will not authorize your transaction.

Role of Card Issuer

PayGOV.US LLC accepts and processes cards bearing the Visa®, MasterCard®, American Express®, and Discover®, brands only. We will not attempt to obtain authorization for a Transaction involving any other type of Card.

Convenience Fees.

Convenience Fees are the Fees charged for initiating a payment through PayGOV. You have the opportunity to cancel any Transaction before making payment and becoming responsible for Convenience Fees, which will be charged to your Account. Convenience Fees are non-refundable.

Agency determines Payment application.

PayGOV will transmit funds as the Agency has directed for all Transactions involving that Agency. Once funds have passed to the Agency from PayGOV, the Agency is solely responsible for how those funds are applied or any refunds. If you disagree with how your payment was applied by the Agency please contact the Agency.

Unauthorized Transaction

If You believe a payment is an Unauthorized Transaction contact PayGOV.US LLC. If a transaction is valid, but a Charge Back or Retrieval Request has been filed, Cardholder may be assessed a fee of $40. You are encouraged to read your agreement with your card issuer. Under most Card Issuing Agreements you agreed to indemnify the Card Issuer of all liability and take upon yourself full liability, up to and including, liability for all Legal Fees and Damages of the Card Issuer. PayGOV retains the right to sue you and your card issuing bank for facilitating fraud when a chargeback is filed and PayGOV loses when proof can be provided of the transactions validity.

PAYGOV’S LIABILITY TO YOU IS LIMITED.

OUR SOLE OBLIGATION IS TO MAKE PAYMENTS TO AGENCIES YOU HAVE IDENTIFIED TO US THROUGH YOUR USE OF THE SERVICE IN THE AMOUNTS THAT PAYGOV.US  HAS BEEN INFORMED BY YOUR CARD’S ISSUER HAVE BEEN AUTHORIZED.  PAYGOV.US AND RELATED SERVICES ARE PROVIDED ON AN AS-IS, AS-AVAILABLE BASIS. PAYGOV.US MAKES NO WARRANTIES THAT ALL OR ANY PART OF THE SERVICE WILL BE ERROR FREE OR UNINTERRUPTED AND DISCLAIMS ALL OTHER REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES REGARDING QUALITY, SUITABILITY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. PAYGOV.US LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES YOU BELIEVE YOU HAVE SUFFERED OR INCURRED AS A RESULT OF PAYGOV.US PROVIDING THE SERVICE UNDER THIS AGREEMENT.

Agency Funding

PayGOV contracts with each Agency to determine funding. Typically, deposits take place intwo-business days via ACH. Some Agencies may choose to receive funds by mailed check. Weekends and Holidays affect the timing of PayGOV.US LLC deposits to an Agency.

Payment Compliance

Our business is designed to help you make payments to a government Agency. We expect your use of the PayGOV.US LLC will be lawful. We have the right to bar you from using the Service if you violate these Terms or any law, regulation or rule in making your payment, provide false information in connection with your payment, or refuse to cooperate in any investigation into any Claim. FRAUDULENT CARD USE IS A CRIMINAL OFFENSE PUNISHABLE BY LAW.

 Additional anti-fraud verifications.

Some Payments approved by the card issuer may be subject to further verification by PayGOV.US LLC to prevent fraud. If this process is completed successfully, PayGOV.US LLC will send a notice of your payment to the agency you identified. Payments that do not successfully complete this process will be rejected even if approved by the card issuing entity.

Other Terms apply generally to the Service.

Assignment.

These Terms and any rights granted and obligations you accept hereunder are personal to you and you may not transfer or assign them to anyone else.

Complete Agreement.

These Terms, along with Our Privacy Policy forms the entire understanding between you and PayGOV regarding Your use of the Service. PayGOV may amend these Terms at any time and without notice by posting an updated version on Our web site. If a court holds any of these Terms to be invalid or unenforceable any Term or part of a Term that was not held to be invalid or unenforceable will still apply and will be enforced.

Applicable Law and Jurisdiction. You agree that:

 

    • The Service PayGOV.US LLC provides is solely based in and reliant upon human and technical resources that are within the State of Indiana.

    • The PayGOV.US LLC website is a passive website requiring You to input accurate information and take other actions to complete a Transaction.

    • Using PayGOV.US LLC does not result in personal jurisdiction for any purposes over PayGOV.US LLC outside of the State of Indiana.

    • The laws of the State of Indiana, excluding the laws of conflict or choice of law, apply exclusively to the interpretation of these Terms.

    • Any legal action You may take against PayGOV.US LLC may only be filed within a state or federal court of competent jurisdiction in the County of Marion, State of Indiana.
